[대법원]"근로자 월차휴가 시기, 사용자 임의변경 못해"

▣[대법원]"근로자 월차휴가 시기 사용자 임의변경 못해" 판결

근로자의 월차 휴가는 사용자가 임의로 변경할 수 없다는 대법원 판결이
나왔다.

대법원 형사2부(주심 趙武濟 대법관)는 26일 근로기준법위반 혐의 등으로
기소된 택시회사 대표 유모씨(56)에 대한 상고심 선고공판에서 벌금
3백만원을 선고한 원심을 확정했다.

재판부는 판결문에서 “근로기준법상 월차유급휴가의 시기는 사용자가
임의로 변경할 수 없는 것이기 때문에 사용자가 월차휴가 신청을
일방적으로 불허하면서 그 신청시기에 휴가를 하면 무단결근 처리할 것임을
통보했다 하더라도 사용자의 일방 처리에 의해 그 월차유급휴가 신청이
위법한 것이 된다거나 그 근로자들이 월차 휴가한 날에 결근처리 될 수
있는 것이 아니다”며 “따라서 피고인이 근로자들이 신청한
월차유급휴가일을 결근처리하고 성과수당과 기본급을 감액 지급한 것에
대해 유죄로 판단한 원심은 옳다”고 밝혔다.

유씨는 지난해 1월 택시기사 나모씨 등 4명이 신청한 월차휴가를
경영사정을 이유로 불허가고 이들이 출근하지 않자 무단결근으로 처리한뒤
성과수당과 기본급을 감액해 지급한 혐의 등으로 기소돼 1,2심에서 유죄를
선고받았었다.
